OUR TERMS AND CONDITIONS OF SALE

DEFINITIONS:

“Customer” means the individual legitimate legally lawful to enter into contracts that buys or agrees to buy the products from the Seller through the website;

“Contract” means the contract between the Seller and the Customer for the sale and purchase of Products incorporating these Terms and Conditions;

“Products” means the products and / or services that the Customer agrees to buy from the Seller by using the e-shop portal of the website herein; www.bontosa.com

“Seller” means Sweets Hub Foodstuff Trading L.L.C. . a company incorporated under the laws of United Arab Emirates (UAE) and with it’s registered office at Al Garhoud P.O. Box: 16117, Dubai. United Arab Emirates.

“Terms and Conditions” means the terms and conditions of sale set out in this document.

Links available on the websites will allow you to link to websites or resources not maintained or controlled by the Companies. The Companies provide these links for your convenience only and make no endorsements, warranties or representations of any kind whatsoever regarding those other websites and expressly disclaim all responsibility for content on third party websites. You acknowledge and agree that the Companies shall not be held responsible for the legality, accuracy or inappropriate nature of any content, advertising, products, services, or information located on or through any other websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such content.

TERMS:

You have a valid credit card which is under the customer’s name.
Sweets Hub Foodstuff Trading L.L.C. is not responsible for the misusage of a customer’s credit card online. The customer should get in touch with their bank if any purchases are made using their card. Once an order is placed, we will be sending the confirmation electronically through Email to your registered Email id.

Nothing in these Terms and Conditions shall affect the rights as a consumer.
These terms and conditions apply to all orders for the sale of goods by the seller to the costumer through the website and prevail over any other documentation or communication from the costumer. For the avoidance of doubt, the Seller reserves the right to change the terms and conditions at any time without notice.
Confirmation of an order by the costumer through the purchase of products shall be deemed conclusive evidence of acceptance by the costumer of these Terms and Conditions.
No variation of these terms and conditions is permitted.
According to the terms and conditions of this contract, the Seller (Sweets Hub Foodstuff Trading L.L.C.) and the costumer agree as follows:
The delivery charges are to be borne by the recipient.

Payments
We accept Cash on Delivery, Credit Cards, Cash, PayPal. For some Credit card or PayPal transactions, some documents might be requested by the payment gateway for verification purpose. Once the documents are sent by the customer, the order will be processed only after verification by the payment gateway.

Country of product origin: Italy

RIGHTS OF SELLER:

The seller reserves the right to alter the price and specification of any item on the Website at its discretion.
The seller reserves the right to withdraw any Goods from the website at any time.
The Seller shall not be liable for the withdrawal of any Goods from the Website or for refusing to accept an order.

The correct order is confirmed (after choose the metods payments) by a reply by e-mail, sent to the email address supplied by the customer. This confirmation message will contain date and time of the order, an “Order Number” and a “Customer Code”, to be used in any further communication with the e-commerce system.
And ‘your responsibility to register with the correct information and keep up to date the data through the access credentials.

Prices do not include shipping charges and delivery, Seller’s quotation shall include only the packaging in cartons or boxes. In case you require it extra or special packaging, the customer shall inform the Seller. Additional costs will be added to the final price.

Any damage in the product or the mismatch in the number of packages, must be immediately notified, SUBJECT TO INSPECTION WRITTEN on the proof of delivery courier. Once you have signed the Courier, the Customer may not oppose objection on the external characteristic of the delivered goods.

Any problems concerning the physical, correspondence or completeness of the products received must be reported on delivery, as provided herein.

Right of withdrawal:

The right of withdrawal is subject to the following conditions:

  • The law applies to product purchased in its entirety; it is not possible to return only part of the purchased product;
  • The products must be returned intact and in original packaging, complete in all its parts (including packaging and any documentation and accessories); to limit damage to the original package, we recommend, when possible, to put it in another box; should be avoided in all cases the attachment of labels or tape directly on the original packaging of the product;
  • The delivery costs for return of the goods shall be borne by the customer;
  • The delivery until the certificate of receipt in our warehouse is under the full responsibility of the customer;
  • If the goods are damaged during shipping, Sweets Hub Foodstuff Trading L.L.C. will inform the customer (within 7 working days of receipt of goods in their stores), Sweets Hub Foodstuff Trading L.L.C. reserves the right to verify the integrity of the goods and, in the eventuality, to retain a part corresponding to the value of the damage caused to the product or packaging. The only cost that the customer will have to pay is delivery costs.
    Sweets Hub Foodstuff Trading L.L.C. is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.


The right of withdrawal is lost for lack of the essential integrity of the property (the packaging and / or its contents), where Sweets Hub Foodstuff Trading L.L.C. finds:

  • The products to be returned must not be used;
  • The lack of external and / or internal packaging;
  • The absence of elements of the product;
  • The product is damaged for causes other than its transport.


No returns will be accepted and items will NOT be refunded or replaced if the returned products are opened, used or where they are not contained in the original packaging. Any products that emit smoke, perfume, lotions or detergent for clothes will not be eligible for refunds or replacements. The returned product must be returned new, in the original unopened package.

If any term or provision of this Contract is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions will continue in full force and effect as if this Contract had been executed with the invalid, illegal or unenforceable provision omitted.

Delivery time:
All shipments are delivered within 24 hours anywhere in U.A.E. ( Within City Limits- The time of preparation of the product is excluded) and can be tracked online with real time updating.

CHANGES TO TERMS AND CONDITIONS:
The Seller shall be entitled to change these Terms and Conditions at any time.

GOVERNING LAW AND JURISDICTION:
These Terms and Conditions shall be governed by and construed in accordance with the law of United Arab Emirates and the parties hereby submit to the exclusive jurisdiction of the courts of Emirate of Dubai.
